Who Is He?

If you're like many people, when you leave with your bags overflowing, you think the elderly lady at the door is some sweetie pie that Wal-mart, is doing a favor. 

Hah!  Try to tell one of those door checkers that you don't really think you should have to show them the receipt that they just watched the cashier hand you while you wait for her to open and inspect your bags. Keep in mind , that in most states it is illegal to wrongfully detain someone and search thru their personal belonging without a search warrant. 

If you try to breeze on out, not always, but often, they rudely holler after you.  I asked myself, after years of being herded over to the "checker", would I show some stranger off the street my receipt and goodies if they asked.  OF COURSE NOT, so why was I doing it for them.  By such practices, Wal-Mart trains these elderly people to simply harass their customers. Most employees don't have a law degree, therefore, there is no objection to this Wal-Mart policy by the employee. They are trained to do a job, that in some instances can be dangerous to the elderly person they hire to break the law, by wrongfully detaining and illegal search of the customers property .  

When you tell them that you don't wish to play that game, well, it's a toss up as to the response.  I was lucky enough to get one who must take her job very seriously, such as Shirley Barker of Pasadena Texas, right outside of Houston.  She snatched my arm and said to give her my receipt.  We had words, and her clutch was like the crypt creeper or Margaret Hamilton (WWW) on steroids.  Where is the little smiley face when you need him?   I never get stopped at Target,  BestBuy or any of the other discount stores!  So that's where I shop now.  It's my opinion that Wal-Mart by it's training of it's employees of Loss Prevention are in the scope of unfair business practice.  Theft and loss are all a part of doing business, so to be fair to it's competitors, and patrons, Wal-Mart should stop their illegal practice of wrongful detention and breaching the three party contract it has with it's customers and the credit card issuer, namely Visa, MasterCard and American Express.  

Earlier I mentioned how dangerous the job of being a door checker at Wal-Mart can be, which brings me back to the Little 'Ol Lady from Pasadena, Shirley Barker.  This 68 year old woman was all over the national news, I felt so sorry for her when I heard of her story, knowing that Wal-Mart had trained her to do a job.  One that she did quite well, but is against the law, at least in the state of KY. Shirley Barker was a door checker and she asked a man and his companion to open their bag to check it so she could mark their receipt. That’s when she was punched in the face. She was quoted as saying, "He approached. He walked by. He just rolled up his fist and then just went pow," said Barker,  "He said nothing to me at all."  "Bruised the inside, I spit up blood for three days and the right side of my face is all numb," she told reporters.

The drama didn't end there. Barker hurried out of the store after the suspects. Video captured the two casually walking through the parking lot. The camera caught them getting into a four-door Pontiac Grand Prix. As the car backed out, a Wal-Mart employee arrived moments later and attempts to chase down the car.

The man who police say punched Barker is described as an Hispanic male in his early 20s, about 5’8" to 5’10" with a medium build, brown hair and a light mustache. The second suspect is believed to be an Hispanic male in his early 20s, 5’10" to 6’0" with a medium build, brown hair and no apparent facial hair.   Racial Profiling ?

In my suit, I proclaim that my reading of my state law, prohibits a merchant from stopping people unless they are suspected of shoplifting.  So, if they stop everyone, then that must mean something!  Stopping everyone=everyone's a shoplifter.  Is this what you are paying for?
